Terms of Service

By creating a ShineOps account or using any part of the platform, you agree to these Terms of Service. Please read them carefully. ShineOps is operated by Daily Defense Solutions LLC.

1. The Service

ShineOps is a subscription-based business management platform designed for auto detailing professionals. It includes tools for job management, scheduling, customer management, invoicing, online booking, team management, and related features accessible via web browser and mobile application.

2. Eligibility

You must be at least 18 years old and operating a legitimate business to use ShineOps. By agreeing to these Terms, you represent that you meet these requirements. ShineOps is intended for business use only and is not a consumer product.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@getshineops.com if you suspect unauthorized access.

You may invite staff members to access your account. You are responsible for their use of the platform and ensuring they comply with these Terms.

4. Subscription and Billing

Free Trial

New accounts receive a free trial period with full access to ShineOps features. No credit card is required to start your trial. Trial length may vary and will be displayed in your account.

Paid Plans

After your trial, continued access requires a paid subscription. Subscription fees are billed monthly in advance. All prices are in USD.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial months.

Payment Failure

If a payment fails, we will notify you and attempt to retry. If payment cannot be collected, your account may be suspended until the balance is resolved. Your data is retained for 90 days following suspension before permanent deletion.

Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days advance notice of any price increase to active subscribers via email.

5. Acceptable Use

You agree to use ShineOps only for lawful purposes and in accordance with these Terms. You may not:

You retain ownership of all data you enter into ShineOps — your customer records, job history, photos, and business information. You grant ShineOps a limited license to store and process this data solely to provide the service to you.

We will not access your business data except to provide support you have requested, to maintain the platform, or as required by law.

You are responsible for the accuracy of data you enter and for obtaining any necessary consent from your customers to store their information in ShineOps.

7. Customer Communications

ShineOps sends emails and notifications to your customers on your behalf (invoices, booking confirmations, review requests, etc.). You are responsible for ensuring you have the right to contact those individuals and that your use of these features complies with applicable laws including CAN-SPAM and applicable state regulations.

8. Payment Processing

ShineOps integrates with Square for in-person and online payment processing, and with Stripe for subscription billing. Use of these payment processors is subject to their respective terms of service. ShineOps is not responsible for payment disputes, chargebacks, or errors that occur within those third-party systems.

9. Intellectual Property

ShineOps, including its software, design, branding, and content, is the property of Daily Defense Solutions LLC and is protected by intellectual property laws. You may not copy, reproduce, or create derivative works from any part of ShineOps without written permission.

10. Availability and Uptime

We strive to keep ShineOps available and reliable, but we do not guarantee uninterrupted service. Scheduled maintenance, software updates, or circumstances beyond our control may cause temporary downtime. We will make reasonable efforts to minimize disruption and communicate planned outages in advance.

11. Disclaimer of Warranties

ShineOps is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, secure, or meet your specific requirements. Your use of ShineOps is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, Daily Defense Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ShineOps, including loss of data, lost profits, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid to ShineOps in the three months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Daily Defense Solutions LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of ShineOps, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if your account poses a security or legal risk. We will make reasonable efforts to notify you before termination except in cases of serious violation.

You may terminate your account at any time by canceling your subscription and contacting support to request deletion.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.

16. Changes to These Terms

We may update these Terms from time to time. We will notify active account holders of material changes by email at least 14 days before they take effect. Continued use of ShineOps after the effective date of updated Terms constitutes acceptance.
